Website Terms & Conditions of Use

Please read these terms and conditions of use (“TACOU”) carefully before using this website (“Website”) or any mobile applications of the Company (each, a “Mobile Application” and together with the Website, the “Services”). Using any portion of the Services indicates that you accept these TACOU. Transportant, Inc, a Kansas corporation (hereafter referred to as the “Company”) reserves the right to update these TACOU at any time; provided, that, Company will not change how Personal Information (defined below) is collected, used, or shared under these TACAOU without advance notice and consent from the appropriate authority (e.g., a Parent or in loco Parentis school or School District). If you do not accept these terms and conditions, do not use the Services.  

The Services provide you with access to a variety of resources, which may include audio, still and live-motion images, real-time school bus tracking information, product features, and other information, and support services (collectively, the “Services”). The Services, including any updates or enhancements, are subject to these TACOU. The Services are for your personal and non-commercial use, and only as they are provided by the Company and in a lawful manner. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products or services obtained from the Services.

To access the Services and the resources they offer, you will be asked to provide certain registration details or other information. This information, along with your child’s or children’s personal information collected by the Company, including audio and video recordings, and any other personally identifiable and non-public information (collectively, “Personal Information”), is governed by our Privacy Policy. By accessing and using the Services, their resources, or any of the Company’s other services, you consent to all actions we take with respect to your Personal Information consistent with our Privacy Policy.

You also acknowledge that your account is personal to you and agree not to provide any other person with access to the Services or portions thereof using your user name, password, or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to exit from your account at the end of each session, using particular caution when accessing your account from a public or shared computer so that others are not able to access the Services or view or record your password or other personal information. We have the right to disable any user name or password at any time if, in our opinion, you have violated any provision of these TACAU.

The Services and their entire contents, features, and functionality (including but not limited to, school bus tracking information, text, displays, and the design, selection and arrangement thereof), are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. Further, use of the Mobile Application is governed by the Company’s End User License Agreement (“EULA”) available here.

These TACAU permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, transmit, modify, create derivative works of, publicly display, download, or store any of the material on our Services, except the automatic storage of copies of such materials in RAM or web browser cache incidental to your accessing and viewing those materials.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Services in breach of the TACAU, your right to use the Services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title or interest in or to the Services or any content on the Services is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the Services not expressly permitted by these TACAU is a breach of these TACAU and may violate copyright, trademark and other laws.

When you use the Services, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile software provider and the owner of one or more applications or plug-ins. Your use of these third-party services may be subject to the separate policies, TACAU, and fees of these third parties, and are not the responsibility of the Company.

The Services are offered and available to users who are 13 years of age or older. By using the Services, you represent and warrant that you are of legal age to form a binding contract with the Company and to meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services. If the Mobile Application is offered and made available to users under the age of 13, the Mobile Application must be installed on an under-13 user’s mobile device by a user of legal age to form a binding contract with the Company and to meet all of the foregoing eligibility requirements. If this requirements is not met, your child(ren) must not access or use the Mobile Application.

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Transportant™ and Bus Compass™ are the trade and service marks of the Company and may not be used without the Company’s prior written consent. The marks and slogans FaceBook®, the FaceBook “f” symbol, Twitter®, and the Twitter bird symbol are not the property of the Company and are the property of Facebook and Twitter (respectively). All trademarks, service marks, trade names, trade dress, product names and logos appearing on the Services are the property of their respective owners, including in some instances the Company. Any rights not expressly granted herein are reserved by the Company.

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You acknowledge and agree not to use the Services for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way. You may not use the Services in any manner that could damage, disable, overburden, or impair any Company server, or the network(s) connected to any Company server, or interfere with any other party’s use and enjoyment of the Services. You may not attempt to gain unauthorized access to any Services, other accounts, information, computer systems or networks connected to any Company server or to any of the Services, through hacking, password mining, deception of identity, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available to you through the Services. You are not authorized to use the Services or any materials or information on the Services for purposes of competing with the Company or engaging in or contemplating litigation against the Company.  

The design or layout of the Services or any other Company owned, operated, licensed, or controlled site is the property of the Company. Elements of the Services are protected by copyright, trade dress, and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound, or image from any Company Services may be copied or transmitted unless expressly permitted by the Company.  

THE COMPANY MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION AND GRAPHICS PUBLISHED ON THE SERVICES OR THE SERVICES (INCLUDING ANY SUPPORT SERVICES) FOR ANY PURPOSE. ALL INFORMATION, GRAPHICS, AND SERVICES (INCLUDING ANY SUPPORT SERVICES) ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO ALL INFORMATION, GRAPHICS, AND SERVICES OF ANY KIND (INCLUDING ANY SUPPORT SERVICES), INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT AND THE COMPANY MAKES NO REPRESENTATION OR WARRANTY AS TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY AND/OR ITS MEMBERS, MANAGERS, OFFICERS, AGENTS, EMPLOYEES, REPRESENTATIVES, SUPPLIERS, OR CLIENTS BE LIABLE TO ANY PERSON FOR ANY SPECIAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF INFORMATION AVAILABLE FROM THIS SERVER.  

The Company reserves the right to terminate your access to any or all of the Services at any time, without notice, for any reason whatsoever. The Company reserves the right at all times to disclose any information as the Company deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Company’s sole discretion.
